Writ filed to allow JC recommended judges to work
Kathmandu / March 11: A writ petition has been filed at the Supreme Court, demanding an order ensuring assumption of duties by the 11 individuals the Judicial Council has recommended at justices at SC.
Chairman of Consumers’ Rights Protection Forum Nepal and advocate Jyoti Baniya filed the writ petition on Friday, naming the Legislature-Parliament, President’s Office, Office of the Prime Minister and Council of Ministers as defendants.
In the writ, advocate Baniya has also demanded the conduction of parliamentary hearing to allow the recommended 11 judges to work. “There are more than 25,000 cases under consideration at SC, and hundreds of thousand are waiting for justice over the case. The delay on hearing is the lack of justices. And justice delayed is justice denied,” advocate Baniya argues in the application.
Appointment of any eligible citizen as justice falls under the duty of Judicial Council, as per Nepal’s constitution, he further argues. He has also pointed out that the Speaker has no legal authority at all to use discretionary power over the appointments after the recommendation of Constitutional Council and Judicial Council. RSS
