SC team delivers court summons at CIAA Chief Karki’s house;

LokmanKathmandu / Oct 18: After repeated attempts, a team of Supreme Court on Tuesday pasted court summons at the residence of Commission for the Investigation of Abuse of Authority (CIAA) Chief Lokman Singh Karki.

A staffer at the apex court, who was assigned to deliver the notice, has submitted a report to the court’s administration mentioning that the notice has been served.

SC Spokesperson Nahakul Subedi said that the court has been informed that the notice has been served. Muluki Ain and SC regulations state that a court’s notice can be served at a defendant’s house, rented room or a nearby public place.

Earlier, Karki had refused to receive the court summons on various pretexts. Based on the provision, SC staffer served the notice and prepared a site report in presence of ward secretary.

Karki now has to appear by himself or send his representative before the court within 15 days. He, however, can extend that term to 30 days.

Advocate Om Prakash Aryal had challenged Karki’s appointment as CIAA Chief at the court claiming the appointment was unlawful as his tenure in government service “falls short of what has been provisioned in the constitution and he does not hold high moral character to lead the CIAA”.

Meanwhile, the court has prepared to take action against its staffer Shambhu Bahadur Khatri for his negligence during the delivery of court summons. Khatri had gone out of contact by keeping his mobile phone off when the SC team tried to paste the summons for the second time on October 6.

The court has slapped a fine of Rs1,000 and 15 days in jail to Khatri, KMC Ward no.10 Secretary Sarita Rai and an official Bheshraj Aryal.
