Writ filed at Supreme Court against CJ appointment delay

Supreme CourtKathmandu / May 20: A writ has been filed at the Supreme Court demanding immediate appointment of chief justice today. The writ filed by advocate Santosh Bhandari states that even after two months of retirement of former Chief Justice Gopal Parajuli, the constitutional council is yet to appoint one.

The writ petition has also demanded mandamus against federal parliamentarian secretariat, prime minister, speaker and deputy speaker of House of Representatives, chairperson of national assembly and opposition parties.

A preliminary hearing for the writ is scheduled for Tuesday. According to sub section (3) of the constitution of 2074, a new chief justice must be appointed within a month after a chief justice retires or tenders resignation.

Earlier, the judiciary council secretariat had already proposed acting chief justice Deepak Raj Joshi and justices, Om Prakash Mishra and Cholendra Sumsher JBR to the council.
