SC issues interim orders against government decision

Supreme CourtKathmandu / Aug 17: The Supreme Court (SC) has issued an interim order in the name of the government barring it from implementing the decision to withdraw the names of 14 ambassadors recommended to different countries.

A single bench of Chief Justice Sushila Karki issued the order to not implement and have the decision to withdraw the names implemented.

The Parliamentary Hearings Special Committee (PHSC) has already cleared the names of seven out of 21 recommendations coming from the preceding government. The seven, who cleared the hearings, are from the country’s foreign service.

Yuvraj Karki, Shiva Maya Tumbahamphe, Khadga Bahadur KC and Narad Nath Bhardwaj recommended for representing Nepal in South Korea, Israel, Japan and Sri Lanka respectively filed a writ petition at the SC on August 16 with reference to the government’s decision to withdraw their names in course of the parliamentary hearings.

The Council of Ministers on April 18 recommended names for ambassadorial appointment in 22 countries. The new government on August 5 took the decision to withdraw the names of 21 individuals. The order of certiorari demands cancellation of the decision – which violates the constitutional provision – taken by the PHSC majority against the necessity to conduct hearings.

The petitioners have called for a mandamus order to complete the parliamentary hearings and implement the recommendation for the appointment along with an issuance of the interim order against appointment of any other individuals in the ambassadorial positions for the designated countries until the settlement of the case.
